Permanent Total Disability — When You cannot Work

When because of your injury, your age, education or experience you are unable to return to work because of a workplace injury, you may qualify for permanent total disability benefits. If you suffer a permanent total disability, you are eligible to receive workers' compensation benefits for the remainder of your life.

It goes without saying that insurance companies rarely want to admit that a person suffers a permanent total disability. This will occur usually only after a person provides convincing evidence to a North Carolina Industrial Commission commissioner. We will work with you to obtain the benefits that you deserve — whether that is through weekly benefits, a lump sum payment or a structured settlement.

Permanent Partial Disability — When You Reach Maximum Medical Improvement

When you recover physically as much as you are going to recover (maximum medical improvement), you may be able to collect permanent partial disability benefits. These benefits compensate injured workers for their construction accident, industrial accident or other workplace injury and their inability to return to the same level of function.

Your doctor should assign a specific impairment rating. Under the Workers Compensation Act, an injured worker is entitled to compensation for this impairment rating. We can assist you by obtaining an independent medical examination to provide a second opinion about your injury and the level of impairment you suffer.
